Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern the use of the Shazamio online store operated by Fylatela v.o.s., located at Bančíkovej 1/A, Bratislava 821 03, Slovakia, ID No. 56190620 (“Seller”). By placing an order on Shazamio (“Website”), you agree to be bound by these Terms. Please read them carefully.

2. Definitions

2.1. Buyer: Any natural or legal person who enters into a Purchase Agreement with the Seller.

2.2. Goods: Products listed on the Website for sale, including electronics, gadgets, and accessories.

2.3. Purchase Agreement: A contract between the Buyer and the Seller for the purchase of Goods.

3. Information about Goods and Prices

3.1. Product Information: Details about Goods, including prices and descriptions, are available on the Website. All prices include applicable taxes but exclude delivery costs.

3.2. Price Changes: Prices are subject to change without notice, but changes will not affect orders already confirmed by the Seller.

4. Ordering Process

4.1. Placing an Order: Orders can be placed through the Website by following the online instructions. The Buyer must provide accurate and complete information.

4.2. Order Confirmation: Upon receiving an order, the Seller will confirm receipt by sending an email to the Buyer. This confirmation does not constitute acceptance of the order.

4.3. Acceptance of Order: The Purchase Agreement is formed when the Seller sends an email confirmation that the Goods have been dispatched.

5. Payment Terms

5.1. Payment Methods: The Buyer can pay using SEPA transfers. We are working on adding card payment options via Stripe in the future.

5.2. Payment Due Date: Payment must be made in full before the Goods are dispatched.

6. Delivery

6.1. Delivery Methods: The Seller uses local couriers to deliver Goods.

6.2. Delivery Times: Orders are typically delivered within 5-7 business days.

6.3. Delivery Costs: A flat rate of €8 applies to all deliveries within the European Union. Orders over €69 qualify for free shipping.

7. Right of Withdrawal

7.1. Withdrawal Period: The Buyer has the right to withdraw from the Purchase Agreement within 14 days of receiving the Goods.

7.2. Withdrawal Process: To exercise this right, the Buyer must notify the Seller in writing via email or mail and return the Goods in their original condition.

8. Warranty and Complaints

8.1. Warranty: The Seller warrants that the Goods are free from defects at the time of delivery.

8.2. Complaints Procedure: If the Buyer receives defective Goods, they must contact the Seller within 24 hours of delivery. The Seller will provide instructions for returning the Goods for inspection and potential replacement or refund.

9. Limitation of Liability

9.1. The Seller is not liable for any indirect, incidental, or consequential damages arising from the use of the Goods.

9.2. The Seller’s total liability to the Buyer in respect of any loss arising under or in connection with the Purchase Agreement shall not exceed the total amount paid by the Buyer for the Goods.

10. Privacy

10.1. The Seller processes personal data in accordance with its Privacy Policy, which is available on the Website.

11. Governing Law and Jurisdiction

11.1. These Terms are governed by the laws of Slovakia. Any disputes arising from the Purchase Agreement will be subject to the exclusive jurisdiction of the courts of Slovakia.
